These Terms & Conditions ("Terms") govern your access to and use of the website at nextbullishtrade.com and all related content, tools, subscriptions, courses, and services (together, the "Service"), operated by Next Bullish Trade ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Not financial advice

The Service is provided for educational and informational purposes only. Nothing on the Service is, or should be construed as, financial, investment, legal, tax, or other professional advice, or a recommendation, offer, or solicitation to buy or sell any security, option, or other financial instrument.

We are not a registered broker-dealer, investment adviser, or financial planner. Grades, scores, signals, ideas, levels, targets, and any other output are algorithmic or AI-generated opinions and pattern reads, not predictions or guarantees. You are solely responsible for your own trading and investment decisions and for conducting your own due diligence.

2. No guarantees & assumption of risk

Trading and investing in stocks and options involve substantial risk, including the possible loss of your entire investment. Options in particular can lose value rapidly and may expire worthless. Past performance, backtests, and hypothetical results are not indicative of future results.

We make no guarantee of any profit, result, or outcome. Any results described are not typical and depend on factors outside our control. You acknowledge that you use the Service at your own risk and that you alone bear responsibility for any losses.

3. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you represent that you meet these requirements and that all information you provide is accurate.

4. Accounts & access

Some features require an account, member access link, or paid subscription. You are responsible for keeping your access credentials and any member/claim links confidential and for all activity that occurs under your access. Member and course access is personal to you and may not be shared, resold, or transferred.

5. Subscriptions & billing

• Paid subscriptions (including NBT Pro) are billed on a recurring basis through our payment processor, Stripe, at the price and interval shown at checkout.
• Your subscription automatically renews at the end of each billing period unless you cancel before the renewal date.
• You can cancel at any time; cancellation stops future renewals. Access continues until the end of the period you've already paid for.
• Prices may change; we will give reasonable notice, and changes apply to subsequent billing periods.
• You are responsible for any applicable taxes.

6. Refund policy

Because the Service provides immediate access to digital content and tools, all sales and subscription payments are final and non-refundable, except where a refund is required by applicable law.

• Subscriptions — you may cancel at any time to avoid future charges. We do not provide refunds or credits for partial billing periods, unused time, or periods during which you did not use the Service.
• Courses and one-time digital purchases — these are non-refundable once access has been granted, given their digital nature.
• Duplicate or erroneous charges — if you believe you were charged in error, contact us at info@nextbullishtrade.com within 14 days and we will review the charge in good faith.

Any refund that we choose to grant is at our sole discretion and does not obligate us to provide future refunds.

7. Acceptable use

You agree not to:

• Copy, scrape, redistribute, resell, or republish the Service's content, data, or output without our written permission.
• Share, resell, or circumvent paid access, member links, or paywalls.
• Reverse-engineer, interfere with, overload, or attempt to gain unauthorized access to the Service or its systems.
• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Misrepresent the Service's output as personalized advice from a licensed professional.

8. Intellectual property

The Service, including its content, software, grading framework, design, text, graphics, and logos, is owned by us or our licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own personal, non-commercial use. All rights not expressly granted are reserved.

9. Third-party data & links

The Service relies on third-party market data, news, and other sources, and may link to third-party websites. We do not guarantee the accuracy, completeness, or timeliness of any third-party data, and we are not responsible for the content, products, or practices of any third party.

10. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any data or output will be accurate or reliable.

11. Limitation of liability

To the fullest extent permitted by law, in no event will Next Bullish Trade, its owners, operators, affiliates, or contributors be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, trading losses, revenues, data, or goodwill, arising out of or related to your use of (or inability to use) the Service — even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the three (3) months before the event giving rise to the claim, or (b) USD $100.

12. Indemnification

You agree to indemnify and hold harmless Next Bullish Trade and its owners, operators, and affiliates from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or the rights of any third party.

13. Changes to the Service or Terms

We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time; the "Last updated" date reflects the latest version. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing law

These Terms are governed by the laws of the United States and the State of Texas, without regard to conflict-of-law principles. You agree that any dispute will be resolved in the state or federal courts located in Texas, unless otherwise required by applicable law.
